Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Personal AI LLC ("Personal AI LLC," "we," "us," or "our"), the operator of Lexi & Chad (the "Service"), available at lexiandchad.com and via text message. By starting or continuing a conversation with the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for users in the United States.

2. What the Service is

Lexi & Chad is an AI-powered fitness and nutrition companion delivered over text message (iMessage). It can log meals and workouts, estimate calories and macronutrients, build general workout and meal suggestions, send reminders and check-ins, generate images, and chat about your goals. The coaching personas ("Lexi" and "Chad") are fictional AI characters, not real people.

3. Not medical, nutritional, or professional advice

The Service does not provide medical, dietary, psychological, or professional fitness advice, diagnosis, or treatment, and is not a substitute for consultation with a licensed physician, registered dietitian, certified trainer, or other qualified professional. Calorie counts, macros, and other figures are estimates and may be inaccurate. Do not rely on the Service for medical decisions. If you think you may have a medical emergency or a health condition (including an eating disorder, pregnancy, injury, or any condition affected by diet or exercise), seek professional care first. In the U.S., you can reach the 988 Suicide & Crisis Lifeline by calling or texting 988.

4. Assumption of risk

Physical exercise and dietary changes carry inherent risks. You voluntarily choose to follow any suggestion from the Service and assume full responsibility for the risks, including injury or illness. You agree to consult a physician before beginning any new exercise or nutrition program.

5. AI-generated content

Responses, images, plans, and numbers are generated by artificial intelligence and may be inaccurate, incomplete, or not suitable for your situation. Use your own judgment and verify important information. Generated images are illustrative and do not depict real people.

6. Subscriptions, billing & cancellation

The Service offers a free trial allotment of messages. Continued use beyond that requires a paid subscription, currently $14.99 per month, billed through our payment processor, Stripe.
Subscriptions automatically renew each month until you cancel. By subscribing, you authorize us (via Stripe) to charge your payment method on a recurring basis until cancellation.
You can cancel anytime from your account page at lexiandchad.com/account. When you cancel, you keep access until the end of the current billing period.
Refunds: payments are non-refundable, and we do not provide refunds or credits for partial billing periods, except where required by law.
Prices may change; we will give notice of any change before it applies to you.

7. Acceptable use

You agree not to use the Service to:

break any law or regulation, or infringe anyone's rights;
send unlawful, harassing, abusive, or exploitative content;
seek instructions for self-harm or for harming others;
reverse-engineer, scrape, overload, or interfere with the Service; or
misrepresent your identity or use the Service on behalf of someone under 18.

We may suspend or terminate access for any violation, or for any reason, at our discretion.

8. Your content

You retain ownership of the messages, photos, and information you send. You grant Personal AI LLC a license to use, store, and process that content as needed to operate and improve the Service, including transmitting it to the third-party providers described in the Privacy Policy. Do not send content you do not have the right to share.

9. Intellectual property

The Service, including the Lexi & Chad name, characters, software, and content we provide, is owned by Personal AI LLC and protected by law. We grant you a limited, personal, non-transferable license to use the Service for your own personal, non-commercial use.

10. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate.

11. Limitation of liability

To the fullest extent permitted by law, Personal AI LLC and its owners, members, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, loss of data, or lost profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 3 months before the claim, or $50.

12. Indemnification

You agree to indemnify and hold harmless Personal AI LLC from any claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms.

13. Governing law & disputes

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Utah, and you consent to their jurisdiction. You and Personal AI LLC agree to first try to resolve any dispute informally by contacting us.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date, and your continued use of the Service means you accept them.

Messaging Terms (SMS / iMessage)

Lexi & Chad operates through text messages sent to and from +1 (821) 202-8407. By starting a conversation, you consent to receive recurring automated and AI-generated text messages from us, including coaching replies, check-ins, reminders, and occasional re-engagement messages.

Consent: messaging consent is not a condition of any purchase. You consent to messages by texting us first and continuing the conversation.
Frequency: message frequency varies based on your activity and settings.
Cost: message and data rates may apply, depending on your carrier and plan. We do not charge you for the messages themselves; your subscription is separate.
Opt-out: reply STOP at any time to stop receiving messages. You can reply START to resume.

Carriers and messaging providers are not liable for delayed or undelivered messages.

Privacy Policy

This Privacy Policy explains how Personal AI LLC collects, uses, and shares information when you use Lexi & Chad.

1. Information we collect

Contact info: your mobile phone number, and your first name (and last name) if you share it.
Messages & media: the texts, photos (such as pictures of meals), and files you send, and the messages we send back.
Health & fitness data: information you provide about your meals, calories and macros, workouts, body metrics, goals, and preferences. This can include health-related information you choose to share.
Account & usage data: your subscription status, coach and appearance preferences, reminders, approximate time zone (inferred from your area code), and basic usage activity.
Payment data: if you subscribe, your payment is processed by Stripe. We receive limited billing details (such as status and an identifier) but we do not collect or store your full card number.

2. How we use your information

to provide the Service: respond to you, log your food and workouts, and personalize coaching;
to generate AI responses, images, and nutrition estimates;
to send reminders, check-ins, and account or service messages;
to process subscriptions and prevent abuse or fraud;
to maintain, secure, and improve the Service; and
to comply with the law.

3. How we share information (service providers)

We do not sell your personal information. We share it only with vendors that help us run the Service, and only as needed for them to perform their function:

Sendblue — delivers and receives your text messages.
Anthropic (Claude) — the AI that processes your message content to generate coaching responses.
Google (via the Vercel AI Gateway) — generates avatar and exercise-demo images from prompts.
Vercel — hosts and runs the application.
Supabase — provides our database and file storage.
Stripe — processes subscription payments.
USDA FoodData Central and Open Food Facts — we send food descriptions or barcodes (not your identity) to look up nutrition data.

We may also share information to comply with the law, enforce our Terms, protect rights and safety, or as part of a business transfer (such as a merger or acquisition).

4. AI processing

To answer you, your messages and any photos are sent to our AI provider (Anthropic) for processing. We do not use your conversations to train third-party public AI models, and we instruct our providers to handle your data only to provide the Service.

5. Data retention

We keep your information for as long as your account is active and as needed to provide the Service, then for a reasonable period afterward to meet legal, security, and operational needs. You can ask us to delete your data (see below).

6. Your choices & rights

Delete your data: text "delete my data" to your coach, or contact us at (801) 645-6972, and we will delete your account information, subject to limited legal exceptions.
Access or correct: contact us to access or correct your information.
Stop messages: reply STOP at any time to opt out of texts.
Depending on where you live, you may have additional rights (such as under California law) to access, delete, or limit use of your information. We honor these requests where they apply.

7. Security

We use reasonable administrative and technical measures to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Children

The Service is for adults 18 and older. We do not knowingly collect information from anyone under 18. If you believe a minor has used the Service, contact us and we will delete the information.

9. Changes to this Policy

We may update this Privacy Policy from time to time. Changes will be posted here with a new "Last updated" date.
